This website is owned and operated by Ahealo and it is directed towards the visitors, users, members, clients, patients, customers (collectively “users”, “you”). The usage of our website and our services is conditioned upon your acceptance of and compliance with the terms stated in this document. By using and obtaining the services at https://www.web.ahealo.com/, the user is accepting these terms and should cease using the usage of this website if they are not agreed upon.

Ahealo is an online marketplace where users, trainers, and psychotherapists, can interact with each other and advertise, buy, and sell psychotherapy-related services. In addition, Ahealo also provide other means through its technology to users for monitoring their personal mental health. Along with our privacy policy and other policies that may be posted on our website from time to time, these terms and conditions constitute an agreement between the website and the user. All users are believed to be in acceptance of these terms and conditions by using our services from our website. If any user doesn’t agree with our terms, policies, or conditions he or she doesn’t have permission to use our website.

SECTION 2 - REQUIREMENTS

Only individuals who are 18 years of age or older are eligible to use our services. By using any of our services or hiring any of the psychotherapists through our website, you represent and warrant that you are at least 18 years old. If you are under 18 please stop using our website or have attained your parent or guardian’s consent to use the services of our website. 

A user will only have to provide his/her e-mail to use our website. When you create an account, the information you provide needs to be true and accurate. Don’t provide fake or false information, don’t provide information that violates someone else’s rights, and don’t impersonate someone else.

SECTION 3 - USER ACCOUNT, LOGIN, AND PASSWORD

You’ll be asked to register for an account with your e-mail where you will have to provide your e-mail and password. Together this information is used to access your account. It’s your responsibility to keep your login information confidential and you’re responsible for any activity that happens under your account whether or not you authorized it. 

You must never use another user’s account without permission. When creating your account, you must provide accurate and complete information. You agree that you will not solicit, collect, or use the login credentials of other individuals. We prohibit the creation of, and you agree that you will not create, an account for anyone other than yourself. You also represent that all information you provide to us upon registration and at all other times will be true, accurate, current, and complete. You agree to update your information as necessary to maintain its truth and accuracy.

We reserve the right to withdraw access to your account without notice for any actual or suspected breach of these Terms or any other documentation referred to in them, including, without limitation, where we suspect that there has been unauthorized access to your account or any unauthorized disclosure of your login information.

SECTION 4 - CORRECTNESS OF INFORMATION

To the extent permitted by law and set out in these Terms, our website and team have no control over material and information delivered by psychotherapists. While we will endeavor to check the profiles and psychotherapists listings for accuracy and permissibility, then we make no warranties relating to the accuracy, suitability, legality, quality, or availability of any psychotherapists listed on and through our website. It follows that any transaction resulting from listed psychotherapists and taking place between users, cannot be guaranteed by our website.

SECTION 5 - AUTHORITY OF AHEALO

At any time, our website reserves the right to ban or revoke access to our website by any user without notice. All communication posted to the website shall and can be reviewed by the admin with the agreement being terminated by the website for conduct in contravention of the guidelines set out below. These guidelines state that the user cannot use the website to:

   i. Engage in illegal activity.

   ii. Transmit material in breach of the law or breach of the terms set out herein.

   iii. Transmit material that is defamatory and/or identifies an individual in a defamatory way.

    iv. Conduct data mining via the use of additional software or via any other practice.

    v. Submit links to material that is offensive, profane, pornographic, illegal, defamatory, or otherwise inappropriate.

    vi. Submit content or comments that are fraudulent in nature and/or are false or misleading.

    vii. Harass, defame, threaten, or intimidate another individual or entity.

    viii. Break or infringe any copyright, trademark, or any other intellectual property law in any way or manner that may harm now or in the future to our business.

    ix. To chargeback, the amount they’ve already paid, doing so will result in legal proceedings against such users.

SECTION 6 - PROPRIETARY RIGHTS OF AHEALO

All content contained on our website which may include, logos, text, images, illustrations, graphics, videos, audios, clips, drawings, products descriptions, and every other form of intellectual property (“content”) available on or through our website, is the property of Ahealo and our website.  Unless, as expressively, specifically, or otherwise stated, none of the content on our website may be copied, used, distributed, reproduced, modified, changed, republished, displayed, posted, downloaded, or transmitted in any form without the prior approval of Ahealo. You also may not, without Ahealo’s written permission, “mirror” or “frame” any material contained digitally on this website. You are not permitted to copy, change, distribute, modify, publish, transmit, or create derivative works of any material found on this website for any public, personal or commercial purposes.

Ahealo is not a medical organization and cannot – and does not – give you a medical diagnosis or prescribe any pharmaceutical drugs. By purchasing any of the services available through our website, you acknowledge and confirm that you assume full responsibility for any and all damages, injuries, or losses that you may sustain or incur if any while attending or participating in any therapy session, program or activity. You waive all claims against the Ahealo website, its officials, and employees, for any and all claims for injuries or damages that you might sustain. You also understand that you will be participating in the therapy sessions at your own risk and that you are in a good mental condition and have no known mental disabilities that might otherwise be detrimental to your health or well-being.

SECTION 9 - CONFIDENTIALITY DISCLAIMER

All information collected and shared by the users on our website will be held confidential and we will not disclose the information to anyone, except other than we’ve described in our Privacy Policy or where the disclosure of the information is required by the law or for the purpose of rendering our services such as sharing users’ information with third party services providers. However, there may be potential risks involved in providing services through electronic means. There may be delays in services due to the malfunction of internet services or unforeseen and unfortunate events such as strikes, lockdowns, and/or emergencies. We will not be liable to anyone in case of such disruption which is caused by interruption of technology, the force of nature, or any satiation which is beyond our control.

In such a circumstance, we are not liable for any failure to perform or delay in performance of our obligations or shipping under our general terms. Any act, event, non-happening, omission, or accident beyond our control includes (but is not limited to):

    ii. Civil commotion, riot, invasion, cyber-attack, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

    iii. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disasters.

    iv. Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport.

    v. Interruption or failure of utility service (including the inability to use public or private telecommunications networks).

    vi. The acts, decrees, legislation, regulations, or restrictions of any government.

We will use our reasonable endeavors to bring any Force Majeure Event to a close or to find a solution by which our obligations under the general terms or any related contract between us may be performed despite the Force Majeure Event.

SECTION 12 - INDEMNIFICATION AND RELEASE OF CLAIMS

Your use of the Ahealo’s services and your reliance on any kind of information is solely at your own risk. The Ahealo’s website will not be held responsible or liable in any way for the information or services that you request or receive through our website. By buying our services you as a client do hereby indemnify us from all claims that may result in any of the conditions stated above.

The website will take no responsibility for the processing of payments by a third party (such as PayPal, VISA, Mastercard, etc). This must be taken up with the third-party website, policies, and data practices of which we do not control.
